The purpose of this paper is to present current legal issues related to nanotechnology. Undoubtedly, nanotechnology has a big impact on many different areas of law. Emergence of new technologies creates many interesting problems, especially in the field of intellectual property law. Some of them can be solved by using reference to existing legal framework concerning biotechnology, others are new and require closer examination. There are proposals to introduce new regulations concerning nanotechnology to the patent law (as it was done in case of biotechnology). Nevertheless the idea itself was questioned by indicating that most of the problems can be solved by means of interpretation of existing rules. Nanotechnology creates many concerns for public health, environmental safety and consumer protection – these are areas in which European organs conducts active surveillance. It seems that in the future reaction of European legislator will be inevitable.
