<description>Rethinking Neutrality in Humanitarian Action: Legal and Practical Perspectives

For decades, the importance and impact of the principle of neutrality in international humanitarian action has been debated in the context of its mission. Most publicists and scientists agree about the positive aspects of neutrality, as evidenced by the successful activities of the International Committee of the Red Cross for more than a century. However, there are also critics of neutrality. In particular, they argue that neutrality is based on “tolerating crimes in exchange for carrying out humanitarian activities.” The main goals of this article are the following: to show the essence of the concept of “neutrality” in order to identify “stumbling blocks” that lead to a “distortion” of the understanding of the positive impact of neutrality in international humanitarian activities; to review the contribution of the International Committee of the Red Cross in the context of a strictly neutral international non-governmental organization; to present possible ways of diplomatically and legally developing the concept of “neutrality.” In this research, general and special scientific methods of legal cognition are used. Among them we can note the following: the logical (including analysis and synthesis, deduction, and abstraction), structural, and comparative, as well as dogmatic, etc. legal methods.; Od dziesięcioleci trwa debata nad znaczeniem i wpływem zasady neutralności w międzynarodowych działaniach humanitarnych w kontekście ich misji. Większość publicystów i naukowców zgadza się z pozytywnym aspektem neutralności, o czym świadczy udana działalność Międzynarodowego Komitetu Czerwonego Krzyża od ponad wieku. Istnieją jednak również krytycy neutralności. W szczególności twierdzą oni, że neutralność opiera się na „tolerowaniu przestępstw w zamian za prowadzenie działań humanitarnych.” Główne cele niniejszego artykułu są następujące: ukazanie istoty koncepcji „neutralności” w celu zidentyfikowania „przeszkód”, które prowadzą do „zniekształcenia” rozumienia pozytywnego wpływu neutralności w międzynarodowej działalności humanitarnej; dokonanie przeglądu wkładu Międzynarodowego Komitetu Czerwonego Krzyża w kontekście ściśle neutralnej międzynarodowej organizacji pozarządowej; przedstawienie możliwych sposobów dyplomatycznego i prawnego rozwoju koncepcji „neutralności.” W badaniach tych wykorzystywane są ogólne i specjalne metody naukowe poznania prawnego. Wśród nich można wyróżnić: metody logiczne (w tym analizę i syntezę, dedukcję i abstrakcję), strukturalne i porównawcze, a także dogmatyczne itp. metody prawne.

The present conceptual paper addresses selected issues concerning the emergent pluridisciplinary research topic on survivals—an essential part of the phenomenon of nomostasis—with particular emphasis on its theoretical underpinnings and methodological implications. It argues that the concept of a “legal survival” should be understood as a legal form (a legal institution, i.e. a set of functionally interconnected legal norms, a legal concept, a legal principle, or a legal rule) which had emerged in an earlier socio-economic, political or ideological-cultural context, and had had a specific function within that context but did not disappear despite a profound change of that context. A systemic transformation, such as the transition from feudalism to capitalism, from capitalism to state socialism, or back to capitalism, is a paradigmatic example of such a profound change of context, though not the only possible one. The paper addresses the ontology of legal survivals, drawing attention to the distinction between written law and legal practice, and formulates three tentative propositions concerning the theory of legal survivals: (1) the law of juristic inertia, which emphasises that lawyers tend to use old forms to express new content; (2) the law of functional adaptation of legal forms, which emphasises that old legal forms may be used to fulfil entirely new social functions; and (3) the law of decontextualisation of legal form, which emphasises that law oftentimes becomes entirely detached from its changing social context, even to the extent of becoming an irritant. Finally, the paper addresses the question of the methodology of studying legal survivals, arguing that it calls for a broadly inclusive pluridisciplinary approach, uniting the methods typical of legal history, comparative law, sociology of law and legal anthropology, with an overarching role for legal theory and the philosophy of law.; Niniejszy artykuł koncepcyjny podejmuje wybrane zagadnienia związane z wyłaniającym się, pluridyscyplinarnym obszarem badawczym reliktów prawnych – stanowiących zasadniczy zrąb zjawiska nomostazy – ze szczególnym względnieneim jego teoretycznych podstaw oraz implikacji metodologicznych. Artykuł stoi na stanowisku, iż pojęcie „reliktu prawnego” należy rozumieć jako formę prawną (instytucję prawną, tj. zbiór funkcjonalnie powiązanych norm prawnych, pojęcie prawne, zasadę prawną lub normę prawną), która ukształtowała się w wcześniejszym kontekście społeczno-ekonomicznym, politycznym bądź ideologiczno-kulturowym i pełniła w tym kontekście określoną funkcję, lecz nie zanikła pomimo zasadniczej zmiany tego kontekstu. Przekształcenie systemowe – takie jak przejście od feudalizmu do kapitalizmu, od kapitalizmu do socjalizmu państwowego, bądź też powrót do kapitalizmu – stanowi paradygmatyczny przykład takiej głębokiej zmiany kontekstu, choć nie jest jedynym możliwym przypadkiem. Artykuł analizuje ontologię reliktów prawnych, zwracając uwagę na rozróżnienie między prawem pisanym a praktyką prawną, oraz formułuje trzy wstępne propozycje teoretyczne dotyczące reliktów prawnych: (1) prawo bezwładności prawniczej, które wskazuje, że prawnicy mają tendencję do posługiwania się dawnymi formami prawnymi w celu wyrażania nowej treści; (2) prawo funkcjonalnej adaptacji formy prawnej, które podkreśla, że dawne formy prawne mogą być wykorzystywane do realizacji całkowicie nowych funkcji społecznych; (3) prawo dekontekstualizacji formy prawnej, które wskazuje, że prawo nierzadko ulega całkowitemu oderwaniu od zmieniającego się kontekstu społecznego – niekiedy nawet do tego stopnia, iż staje się elementem drażniącym (irytantem). W końcowej części artykuł podejmuje problematykę metodologii badań nad reliktami prawnymi, wskazując na konieczność zastosowania szerokiego, pluridyscyplinarnego podejścia badawczego, łączącego metody typowe dla historii prawa, prawa porównawczego, socjologii prawa oraz antropologii prawnej, przy nadrzędnej roli teorii i filozofii prawa.

Normative Administrative Documents (NADs), commonly known as ‘red-headed documents’ play a significant role in the Chinese system of administrative governance. However, due to their sheer volume and the lack of clear procedural standards in their formulation, they have frequently become a source of rights infringements and administrative disputes, exposing blind spots in the fundamental rights protection. In the article, we advocate introducing direct judicial review for NADs. This proposal is not aimed at fully embracing strong-form review but rather conceptualises direct review as a limit on limits. In the first section, we concisely reconstruct the current incidental review system and formulate the research problem by identifying the challenges of procedural stagnation, specifically conceptual ambiguity, weak enforcement, and limited legal effect. In the second section, we compare existing reform approaches and evaluate the relative superiority and feasibility of direct judicial review. In the third section, the article proposes a non-linear, multi-level, and differentiated model of normative oversight, centred on the substantive resolution of administrative disputes and tailored to the functional characteristics of NADs. This model distinguishes between instrumental, generative, and displacive types of administrative disputes and coordinates administrative reconsideration, administrative litigation, and constitutional review.; Administracyjne dokumenty normatywne (NAD), powszechnie znane jako „dokumenty z czerwonym nagłówkiem”, odgrywają istotną rolę w chińskim systemie zarządzania administracyjnego. Jednak ze względu na ich ogromną liczbę oraz brak jasnych standardów proceduralnych przy ich tworzeniu, często stają się źródłem naruszeń praw i sporów administracyjnych, ujawniając luki w ochronie praw podstawowych. W artykule opowiadamy się za wprowadzeniem bezpośredniej kontroli sądowej NAD. Propozycja ta nie zmierza do pełnego przyjęcia silnej formy kontroli, lecz ujmuje kontrolę bezpośrednią jako „ograniczenie ograniczeń”. W pierwszej części zwięźle rekonstruujemy obecny system kontroli incydentalnej i formułujemy problem badawczy poprzez wskazanie wyzwań stagnacji proceduralnej, w szczególności niejednoznaczności pojęciowej, słabego egzekwowania oraz ograniczonej skuteczności prawnej. W drugiej części porównujemy istniejące podejścia reformatorskie i oceniamy względną przewagę oraz wykonalność bezpośredniej kontroli sądowej. W trzeciej części artykułu proponujemy nieliniowy, wielopoziomowy i zróżnicowany model nadzoru normatywnego, skoncentrowany na materialnym rozstrzyganiu sporów administracyjnych i dostosowany do funkcjonalnych cech NAD. Model ten rozróżnia instrumentalne, generatywne oraz wypierające typy sporów administracyjnych oraz koordynuje ponowne rozpatrzenie administracyjne, postępowanie sądowoadministracyjne i kontrolę konstytucyjną.

Under the system established by the Third Lithuanian Statute of 1588, each chamberlain’s court (sąd podkomorski) was presided over by a sworn chamberlain (podkomorzy), assisted (at times even replaced) by one or two komorniks (komornicy). The Duchy of Samogitia was a notable exception. From 1764, boundary disputes there were also adjudicated by ciwuns (ciwuni) appointed by the monarch. In exercising their judicial duties, these officials could draw on the assistance of a deputy of their own choosing. The proceedings held on contested land, together with the judgements rendered, were recorded by registrars (regenci). From 1588, the office of chamberlain was elective. Until 1764, local sejmiks (sejmiki) nominated four candidates, from among whom the ruler made the final appointment. In 1764, however, this prerogative was limited from the monarch. In an effort to shorten the duration of boundary litigation, the nobility proposed adding assessors to the composition of the chamberlain’s courts. The office of chamberlain remained a lifetime appointment, although in the latter half of the eighteenth century the nobility advanced proposals to introduce fixed terms of office.; Zgodnie z ukształtowanym przez III Statut litewski z 1588 roku ustrojem sądów podkomorskich w składzie każdego z nich zasiadał zaprzysiężony podkomorzy, którego wspierali, a czasami nawet zastępowali jeden lub dwaj komornicy. Wyjątkiem pozostawało Księstwo Żmudzkie, gdyż od 1764 roku rozstrzyganiem sporów granicznych zajmowali się w nim także mianowani przez monarchę ciwunowie. Przy wypełnianiu obowiązków jurysdykcyjnych mogli oni korzystać z pomocy jednego wybranego przez siebie komornika. Przebieg podejmowanych na spornym gruncie czynności oraz wyroki spisywali regenci. Od 1588 roku urząd podkomorzego był elekcyjny. O ile jednak do 1764 roku sejmiki wyłaniały czterech kandydatów, spośród których władca dokonywał ostatecznego wyboru, o tyle od 1764 roku tego wyboru mu nie pozostawiano. W celu skrócenia czasu trwania procesów granicznych szlachta proponowała dołączenie do składu sądów podkomorskich asesorów. Urząd podkomorzego był dożywotni, choć w drugiej połowie XVIII wieku szlachta zgłaszała propozycje uczynienia go kadencyjnym.
