Capitolo 8. Traduzione e diritto. Traduzione e diritto: un’interdisciplinarietà (in)voluta?

Abstract

The relationships existing between two different disciplines of science may be indispensable, but not necessarily reciprocal. The problem arises when one cannot live without the other remaining indifferent towards it at the same time. That is what happens somewhat frequently in the relationship between translation studies and the law, a kind of cohabitation where only the stronger partner benefits from it, whilst the weaker one must always adapt. In the present chapter the author shall attempt to outline the links between the law understood as legislation, acts and jurisprudence (by explaining the meaning of each term as well as their etymology) and the language intended as a system of signs and a means of communication. In particular, the difficulties arising from the translation of legal and judicial texts shall be highlighted, which consists not only in the process of transferring words and concepts from one language to another or vice versa, but within the same language of reference.
