Aktualna pozycja prawna sygnalisty – standardy unijne a prawo krajowe

Abstract

The article deals with the protection of whistleblowers guaranteed by Directive 2019/1937 of the European Parliament and of the Council of 23 October 2019 on the protection of whistleblowers. The current legal position of the whistleblower, the risks associated with whistleblowing, above all the lack of protection against retaliation by the employer, are presented. The main objectives, purpose, personal and material scope of the Directive were analysed. In addition, the legal solutions that were implemented by the Law of 14 June 2024 on the protection of whistleblowers are characterised.

Artykuł dotyczy ochrony sygnalistów gwarantowanej dyrektywą Parlamentu Europejskiego i Rady 2019/1937 z 23 października 2019 r. w sprawie ochrony osób zgłaszających naruszenia prawa Unii. Przedstawiono aktualną pozycję prawną sygnalisty, ryzyka związane ze zgłaszaniem nadużyć, przede wszystkim brak ochrony przed odwetem ze strony pracodawcy. Analizie poddano główne założenia, cel, zakres podmiotowy i przedmiotowy dyrektywy. Ponadto, scharakteryzowano rozwiązania prawne, które zostały wdrożone ustawą z dnia 14 czerwca 2024 r. o ochronie sygnalistów.
