Znaczenie koncepcji look through approach w podatku u źródła

Abstract

The article examines the problems that may arise from application of look through approach concept on the grounds of withholding tax regime. The analysis covered the essence of this concept as well as particular conditions of its application. An attempt was also made to determine the most frequent mistakes, that lead to inappropriate understanding of this institution.

W artykule omówiono problemy, jakie może wywołać stosowanie koncepcji LTA na gruncie podatku u źródła. Analizie poddano istotę tej koncepcji oraz poszczególne przesłanki jej stosowania. Podjęto również próbę wskazania najczęstszych błędów, które prowadzą do niewłaściwego rozumienia tej instytucji.
