Wolność zgromadzeń na gruncie Ustawy z dnia 20 lipca 2018 r. – Prawo o szkolnictwie wyższym i nauce

Abstract

The purpose of this article is to discuss the institutions, which safeguard the freedom of assembly provided by the Act of 20th of July 2018 – the Law on Higher Education and Science. The aforementioned Act constitutes lex specialis to the general regulations concerning assemblies, which covers assemblies on university premises. The study analyses aspects of the organisation of assemblies, their conduct, dissolution and responsibility for the actions of their participants. The regulations of the Act are discussed in the context of the rules of conduct concerning assemblies contained in the statutes of the Jagiellonian University, the University of Łódź and the University of Warsaw. Furthermore, the provisions of the Law on Higher Education and Science are presented in comparison with the Act of 24th of July 2015 –Law on Assemblies. The analysis also covers case law concerning assemblies on university premises.The final conclusions present de lege ferenda proposals concerning the provisions of the Law on HigherEducation and Science, which aim to more fully realise the freedom of assembly at universities.

Celem niniejszego artykułu jest omówienie instytucji służących urzeczywistnieniu wolności zgromadzeń przewidzianych w Ustawie z dnia 20 lipca 2018 r. – Prawo o szkolnictwie wyższym i nauce. Wspomniana ustawa stanowi lex specialis względem unormowań ogólnych dotyczących zgromadzeń, które obejmuje zgromadzenia na terenie uczelni. W opracowaniu przeanalizowano aspekty organizacji zgromadzeń, ich przeprowadzania, rozwiązywania oraz odpowiedzialności za ich przebieg. Unormowania ustawowe odniesiono do przepisów porządkowych dotyczących zgromadzeń zawartych w statutach Uniwersytetu Jagiellońskiego, Uniwersytetu Łódzkiego oraz Uniwersytetu Warszawskiego. Co więcej, przepisy ustawy Prawo o szkolnictwie wyższym i nauce przedstawiono na tle porównawczym Ustawy z dnia 24 lipca 2015 r. – Prawo o zgromadzeniach. Analizie poddano również orzecznictwo dotyczące zgromadzeń na terenie uczelni. W ramach wniosków końcowych przedstawiono postulaty de lege ferenda dotyczące unormowań ustawy Prawo o szkolnictwie wyższym i nauce, które mają na celu pełniejsze urzeczywistnienie wolności zgromadzeń na uczelni.
